1. Services Provided: Swing Sports Performance (“SSP”) provides golf instruction, physical conditioning, and power development coaching. By booking a session, you agree to follow the safety instructions provided by the instructor.

2. Physical Readiness & Waiver: Golf involves physical activity that carries an inherent risk of injury. Health Warranty: You represent that you are in good physical condition and have no medical reason or impairment that would prevent you from participating in golf training. Assumption of Risk: You voluntarily assume all risks associated with participation, including but not limited to falls, contact with equipment, and physical overexertion. Liability Release: SSP is not liable for any personal injury, property damage, or loss sustained during or as a result of our training sessions.

3. Booking and Cancellation Policy: To respect our instructor’s time and other clients' schedules, we enforce the following: Cancellations: Must be made at least 24 hours in advance to receive a full refund or credit. Late Arrivals: Sessions will end at the scheduled time regardless of the client’s arrival time. No-Shows: Will be charged the full session rate.

4. Payments and Refunds: All payments must be settled prior to the start of the session (upon acceptance by SSP). Lesson packages are non-refundable and must be used within twelve (12) months of purchase.

5. Code of Conduct: We maintain a professional and respectful environment. Swing Sports Performance reserves the right to terminate a session or a client relationship without a refund if a client engages in behavior that is deemed unsafe, disrespectful, or inappropriate.

6. Media Release: By participating in lessons, you grant SSP permission to use photos or videos of your swing/training for promotional purposes on social media or our website, unless you explicitly opt out in writing.

7. “+10 Yards or It’s Free” Guarantee terms: A) Eligibility & Scope: The "10-Yard Distance Guarantee" applies exclusively to the purchase and completion of a 3-Lesson Power Development Package. To qualify, the client must complete all three sessions within a 60-day period to ensure consistent physiological adaptation and skill retention. B) Baseline & Measurement: Initial Assessment: A "Baseline Carry Distance" will be established during the first 15 minutes of Lesson 1 using Swing Sports Performance’s calibrated launch monitor technology (e.g., Trackman, GCQuad, FlightScope). Measurement Standard: Improvements are measured based on Average Carry Distance (not total roll-out) using the client’s primary driver. A minimum of five "clean" strikes will be averaged to determine both the baseline and the final result. C) Client Requirements ("The Work") Power development is a partnership. To invoke the guarantee, the client must: i) Complete the prescribed "at-home" mobility or speed drills assigned between sessions, ii) Use the same equipment (Driver/Ball type) for both the baseline and final measurement. and iii) Attend all sessions in physical condition suitable for high-intensity training. D) The Remedy: If, upon completion of the third lesson, the client’s average carry distance has not increased by at least 10 yards compared to the Lesson 1 baseline, Swing Sports Performance will provide one (1) additional 60-minute lesson at no cost. *This "Free Lesson" must be redeemed within 30 days of the third session. This guarantee provides for additional instruction only; no monetary refunds will be issued under the Performance Guarantee. E) Exclusions: The guarantee is void if the client changes key equipment (e.g., switches to a different driver) between Lesson 1 and Lesson 3, or if an underlying injury prevents the client from swinging at full intended effort.

Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these terms or your use of our services shall be resolved exclusively in the courts of Ontario.

Data Sharing: We do not sell your data. We only share information with third-party tools necessary for our business (e.g., booking software like Jane or Acuity, or swing analysis apps).

Your Rights: Under Canadian privacy laws (PIPEDA), you have the right to access the personal information we hold about you and request corrections or deletion.
